Ontario overhauls OINP streams, invitation criteria through immigration regulations

On May 30 2026 Ontario will revoke all nine existing Ontario Immigrant Nominee Program (OINP) nomination categories, removing the legal basis for every current pathway to provincial nomination. The change, the largest to the OINP since its inception, is part of a broader regulatory overhaul that also introduces new invitation and employer‑verification rules.

Streams that are being revoked

The amendment to Ontario Regulation 421/17 eliminates the following categories:

  • Foreign worker
  • International student with a job offer
  • In‑demand skills
  • Master’s graduate
  • Ph.D. graduate
  • Human capital priorities
  • French‑speaking skilled worker
  • Skilled trades
  • Entrepreneur

After May 30, candidates who meet the former eligibility criteria for any of these streams will no longer qualify for nomination under the existing rules.

Operational changes effective May 30

  1. Invitation authority – The OINP director gains the power to issue both general and targeted invitations to apply (ITAs) across all categories. For targeted draws, candidates are ranked only if they satisfy specific labour‑market or human‑capital attributes set by the director; the highest‑ranking eligible candidates receive ITAs.

  2. Employer verification – For any stream that requires an Ontario job offer, a candidate may apply only if the employer is registered with the OINP director and has provided an eligible job offer. This requirement, previously enforced through the OINP employer portal, is now codified in regulation.

Proposed but unconfirmed redesign

In a December 2025 consultation, Ontario outlined a two‑phase redesign:

  • Phase 1: Merge the three employer‑job‑offer streams into a single stream with two tracks – one for higher‑skill occupations (TEER 0‑3) and another for TEER 4‑5 roles.
  • Phase 2: Replace the remaining streams with three new pathways:
    • Priority Healthcare stream
    • Entrepreneur stream
    • Exceptional Talent stream

No eligibility rules, launch dates, or detailed designs for these proposed pathways have been published.

Outstanding questions

  • EOI profile continuity: Ontario has not confirmed whether existing Expression of Interest (EOI) profiles will transfer to any new streams or if candidates must re‑register.
  • Transition for pending applications: While applications submitted before May 30 are expected to be assessed under the rules in effect at submission, the regulation provides no explicit transitional provisions.
  • Profile withdrawal: During the employer‑portal transition in July 2025, existing profiles were withdrawn; it is unclear whether a similar approach will apply to the current overhaul.

Legislative background

  • Working for Workers Seven Act, 2025: Granted the provincial immigration minister authority to create or eliminate OINP selection streams, replacing the previous requirement for full regulatory amendments.
  • Consultation period: Stakeholder consultation on the redesign closed on January 1 2026.
  • Regulatory amendment: On March 16 2026, Ontario amended its immigration regulation via O. Reg. 47/26, setting the May 30 revocation date and introducing the new invitation and employer‑verification provisions.
