DHS proposes sweeping EB-5 investor visa overhaul

USCIS has proposed a rule to implement the EB-5 Reform and Integrity Act of 2022, with changes affecting investor pathways, fraud enforcement, regional center oversight, and promoter regulation. The proposal was published on July 2, 2026, and has a 60-day public comment period.

The proposed rule would overhaul several parts of the EB-5 investor visa program. Key changes described include:

  • Ending the “troubled business” pathway
  • Expanding fraud-detection authority
  • Expanding revocation power
  • Tightening oversight of regional centers
  • Regulating promoters involved in EB-5 activity
