Beyond the Second Passport: A Private Lagos Briefing on Tax, Wealth, and Succession – IMI Daily

Nigerians accounted for 15 % of all applicants to Grenada’s citizenship‑by‑investment (CBI) programme in the first nine months of 2025, making them the largest single nationality in the scheme.

On 1 January 2026 the Nigeria Tax Act came into force, imposing tax on residents’ worldwide income regardless of where the income is earned or remitted. The Act defines tax residence on any one of the following tests:

  • Domicile in Nigeria
  • Permanent home in the country
  • Habitual abode in Nigeria
  • Substantial economic and immediate‑family ties to Nigeria
  • Physical presence of 183 days or more in any 12‑month period

Residents are subject to marginal tax rates that rise to 25 %. Income taxed abroad can be credited against the Nigerian liability, allowing advisers to estimate the net cost of holding assets in another jurisdiction before a client commits.

Trusts and the Tax Act

If a settlor who is a Nigerian resident can revoke a trust or continues to control and manage its assets, the trust’s worldwide income is taxable in Nigeria. Trustees must assess whether their structures meet this definition.
